What is your Warranty Policy? Mighty warrants that the Mighty device shall be free from material defects in materials and workmanship under normal use for a period of twelve (12) months from the date of original purchase. If your Mighty is defective, then we will provide a replacement free-of-charge including all applicable shipping costs.
To obtain service, you must receive authorization from our customer service team. Please contact the customer service team at heyo@bemighty.com to request a warranty return authorization. You must deliver the product, in its original packaging or packaging providing equal protection to the address provided by the customer service team. We may require a receipt or original proof of purchase.
What does this warranty not cover? This Limited Warranty applies only to products manufactured by or for Mighty which can be identified with the “Mighty” trademark or logo. This Limited Warranty does not apply to the following:
- Products and services other than the Product - Mighty merchandise including but not limited to shirts, and other apparel - Non-Mighty hardware products - Consumables (such as batteries) - Software embedded in the Product and related services provided by Mighty
Note: The Limited Warranty covers a battery that fails from a defect in manufacturing, but it doesn't cover batteries that wear out from normal use.
Additionally, this warranty does not apply to the following situations:
- Damages caused by normal wear and tear, and aging such as discoloration - Damages caused by use with non-Mighty products - Damages caused by abuse, accident, flood, fire, earthquake, misuse, or other external causes - Damages caused by using the Product outside of its intended use - Damages caused by improper voltage or power supply - Damages caused by services performed by anyone who is not an approved agent of Mighty
EXCEPT WHERE PROHIBITED BY LAW, MIGHTY SHALL NOT BE HELD LIABLE FOR ANY INCIDENTAL, INDIRECT, SPECIAL OR CONSEQUENTIAL DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF REVENUE, PROFIT OR DATA RESULTING FROM ANY BREACH OF THE LIMITED WARRANTY. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF SPECIAL, INDIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.
What will we not do? Mighty will not provide monetary refunds for defective units after 30 days. Only replacement items will be sent. Mighty will not recover or reinstall software programs and user data.
What must you do to keep the warranty in effect? This Limited Warranty does not apply to a Product or part of the Product that has been modified or altered by anyone who is not an approved agent of Mighty.
How does state law relate to this warranty? This Limited Warranty shall be governed by the laws of the State of California, USA, without giving effect to any conflict of laws principles that may provide the application of the law of another jurisdiction.
Other Info Mighty does not warrant that the operation of the Product will be uninterrupted or error-free.
No Mighty representative, seller, agent, or employee is authorized to make any modification, extension, or addition to this Limited Warranty. If any term is held to be illegal or unenforceable, the legality or enforceability of the remaining terms shall not be affected or impaired.
Consumers in some jurisdictions may have legal rights under applicable national legislation governing the sale of consumer goods, including, without limitation, national laws implementing EC Directive 99/44. These rights are not affected by the warranties in this Limited Warranty.
